Short-Term Rental Regulations

Short-term and vacation rentals are legal in Peoria and cannot be banned by the city under Arizona’s state preemption law, ARS 9-500.39, part of state Senate Bill 1168. Owners must designate a 24 hour emergency contact, notify surrounding neighbors within roughly 300 feet of the rental along with emergency contact information, carry at least $500,000 in liability insurance unless provided by the booking marketplace, conduct sex offender background checks on guests if not already screened by the marketplace, and display the city registration or permit number in all advertisements.

There is no maximum nights cap and no owner-occupancy or primary-residence requirement, except Arizona’s statewide rule, effective September 14, 2024, requiring the owner to reside on-site only where the STR is an accessory dwelling unit with a certificate of occupancy issued on or after that date.

Enforcement is moderate: failing to apply within 30 days of a written violation notice can bring civil penalties up to $1,000 per month, and a permit can be suspended for up to 12 months after three verified violations in a rolling 12 month period or a single serious infraction. Operators must also hold an Arizona Transaction Privilege Tax license and remit transient lodging taxes, with the combined transient lodging tax on short stays running approximately 12.87%.
