Short-Term Rental Regulations

Short-term rentals are legal in Nampa and cannot be banned under longstanding Idaho law (Idaho Code 67-6539, enacted 2017), which limits cities to ‘reasonable’ health and safety regulations. Historically, Nampa required hosts to obtain a city Short-Term Rental License costing $80 per year (renewed annually), submitting proof of ownership, a site plan, proof of liability insurance, and a designated local contact, with operational rules covering off-street parking, occupancy of two per bedroom plus two, quiet hours, and no event hosting.

That framework is being eliminated. Idaho House Bill 583, signed by Governor Brad Little on March 16, 2026 and effective July 1, 2026 with an emergency clause, broadly preempts local STR regulation statewide. It bars cities and counties from requiring a license, fee, permit, certification, or registration to operate an STR, and prohibits mandates for professional management, extra insurance, STR-specific parking, structural modifications, sprinklers, STR-specific inspections, or reporting of rental activity. Existing conflicting permit programs, including Nampa’s $80 license, must be repealed or revised before the July 1, 2026 effective date. Cities retain only limited authority over basic life-safety requirements.

Occupancy tax is 8.0%. Enforcement is rated minimal, and is expected to become even lighter once the statewide preemption takes full effect. Investors evaluating Nampa should treat 2026 as a transition year: any regulatory friction described in older sources is being actively dismantled by state law.

Market Comparison

Nampa shows a striking divergence from national short-term rental benchmarks: occupancy runs dramatically above the norm while ADR runs well below it. At 80.52% occupancy, the market is about 25.5 percentage points above the roughly 55% national median, one of the largest gaps in this report. Average daily rate of $176.09 is about 20.0% below the roughly $220 national median ADR, reflecting a high-volume, value-priced market rather than a premium destination.

Among property managers, Premium Rentals leads with 72 active listings (2.1% of the area’s 3,455 total listings) and 2,398 reviews at a 4.71 average rating. ITrip Vacations holds the highest guest rating among the top five at 4.91 across 48 listings. Evolve ranks third with 59 listings and the highest review count among the top five, 2,626, at a 4.83 rating. The top five combined operators hold 286 listings, about 8.3% of total inventory, indicating a market still dominated by independent and smaller operators.
