Eagle operates under one of the most permissive short-term rental regulatory environments in the country. Idaho Code 67-6539 classifies STRs as a nontransient residential land use and prohibits cities and counties from banning or effectively zoning out short-term rentals. Idaho House Bill 583, signed by Governor Little on March 16, 2026 and effective July 1, 2026, extends preemption further: local governments are barred from requiring any license, permit, fee, certification, or registration to operate an STR. Owner-occupancy requirements, caps on rental nights, limits on the number or proximity of STRs, and mandatory rental-activity reporting are all prohibited. Eagle does not operate its own STR permit program. The only mandatory compliance items are tax remittance and basic health and safety standards. Operators owe Idaho’s 6% state sales tax plus a 2% Travel and Convention tax (8% combined) on stays of 30 days or less. Platforms such as Airbnb and VRBO register with the Idaho State Tax Commission and collect and remit these taxes on facilitated bookings. Local governments retain the ability to enforce consistently applied health and safety standards, including smoke alarms, fire extinguishers, and carbon monoxide detectors. No permit cost, no night caps, and minimal enforcement characterize this market.
